Terms of Service
The terms that govern use of this website and purchases of BOTCOM Technologies services.
1. Agreement and service scope
These terms apply to use of the BOTCOM Technologies website and our website, automation, and digital infrastructure services. By placing an order or accepting a proposal, you agree to these terms and the applicable order or proposal. A specific written order or proposal controls if it expressly states different terms for that project.
Deliverables, exclusions, revision expectations, integrations, timing, and responsibilities are determined by the applicable order or proposal. Final scope may be confirmed before substantive custom work begins. Complex or custom requests may require a separate quote. No service begins solely because you submit an inquiry.
2. Standardized Website Factory offers
BOTCOM Website Factory currently offers one-time website builds: Starter at $499, Business at $999, and Pro at $1,499. Each build’s included items are described on our Website Factory page and at checkout.
BOTCOM also offers monthly managed plans: Managed Care at $79/month and Managed Growth at $199/month. Build + Managed Care bundles are Starter + Care at $499 one-time plus $79/month, Business + Care at $999 one-time plus $79/month, and Pro + Care at $1,499 one-time plus $79/month. Amounts due and billing dates are shown at checkout. Major new features, redesigns, custom integrations, extensive content work, and work outside the agreed scope are not automatically included.
Prices are in US dollars. Applicable taxes and checkout charges are displayed at checkout. Domain registration and renewal, premium software, and other third-party charges are separate unless expressly included.
3. Client responsibilities
You must provide accurate business information, timely approvals, necessary access, and content you are authorized to use. You are responsible for the accuracy, legality, and rights associated with your text, images, logos, business claims, and other supplied materials.
You must have authority to engage BOTCOM on behalf of your business. Do not send passwords or payment card information through our contact form. Any necessary credentials should be exchanged using an agreed secure method. Delays in materials, approvals, or third-party access may affect delivery schedules.
4. Delivery, review, and changes
Delivery expectations are confirmed after requirements, content, access, and capacity are reviewed. There is no universal guaranteed turnaround. We provide an appropriate review and revision process within the agreed scope.
Requests outside the approved scope may affect price and schedule and require separate approval. You are responsible for reviewing the final content and functionality. Launch and handoff arrangements are described in your order or coordinated with you before deployment.
5. Payments and renewals
Payments are processed through Stripe-hosted checkout. BOTCOM does not directly store full payment card details. Payment amounts and the recurring nature of a managed plan are displayed at checkout.
Managed plan subscriptions (Managed Care and Managed Growth, including when purchased in a bundle) renew monthly until canceled. The checkout and applicable order identify billing dates and when recurring charges begin. Do not assume subscription billing is paused during content delays unless BOTCOM confirms this in writing.
You may request cancellation before the next billing cycle through our contact page to stop future renewals. See our Refund & Cancellation Policy for project refunds and current-period charges. Service may be suspended for overdue payments, subject to applicable law and any agreed terms.
6. Ownership and licenses
You retain ownership of the content and materials you supply and give BOTCOM permission to use them to perform the agreed service. After full payment, rights to custom deliverables are provided as stated in the applicable order or proposal.
BOTCOM retains rights to pre-existing methods, reusable tools, code libraries, and know-how. Third-party software, templates, fonts, and other licensed materials remain subject to their respective licenses. Domain ownership remains with the authorized domain holder.
A one-time website launch includes the agreed handoff. Ongoing hosting is separate unless included in the order. On termination of a managed plan, hosting and managed support end at the close of the paid period unless otherwise agreed. Migration, export, and handoff availability depend on the platform and agreed scope; discuss them before service ends.
7. Third-party services and support
Services may rely on hosting, domain registrars, AI tools, payment processors, and other providers. Those providers’ terms, limits, licenses, availability, and fees apply. BOTCOM cannot guarantee uninterrupted availability of third-party services.
Managed support covers the agreed plan scope and reasonable content changes. Standardized plans do not include 24/7 support, an uptime guarantee, or a guaranteed response time unless specifically agreed in writing. Submit service and support requests through the contact page.
8. Acceptable use and oversight
You may not use our website or services for unlawful activity, fraud, infringement, harmful code, abusive conduct, unauthorized access, or misuse of personal or confidential information. BOTCOM may decline or suspend work that creates a reasonable security, legal, or abuse concern.
AI-assisted outputs may be incomplete or inaccurate and require appropriate human review. You remain responsible for consequential business decisions, lawful use of systems, and approvals of content and actions. We do not promise fully autonomous business operation.
9. No guaranteed business outcomes
BOTCOM does not guarantee search rankings, traffic, leads, sales, revenue, or any other particular business outcome. Performance depends on factors outside our control, including your market, content, offer, third-party systems, and ongoing business activity.
Except for express commitments in the agreed scope and to the extent permitted by law, services and the website are provided without additional warranties, including implied warranties of merchantability, fitness for a particular purpose, or uninterrupted operation. This does not remove obligations to deliver the agreed scope or rights that cannot legally be excluded.
10. Limitation of liability
To the maximum extent permitted by applicable law, BOTCOM will not be liable for indirect, incidental, special, consequential, or punitive losses, including lost profits or business opportunities, arising from use of this website or services.
To the extent permitted by law, BOTCOM’s aggregate liability for a claim relating to a service is limited to the amount paid to BOTCOM for that service during the 12 months preceding the event giving rise to the claim. These limits do not apply where prohibited by law or to liability that cannot legally be excluded.
11. Termination and disputes
Either party may end services as allowed by the applicable order and cancellation policy. Payment obligations for completed work and any rights or responsibilities intended to survive termination remain in effect.
If a concern arises, contact BOTCOM with the relevant project or order details so we can seek a practical resolution. These terms do not restrict mandatory rights or remedies under applicable law.
12. Changes to these terms
We may update these terms. The updated date appears at the top of this page. An existing project remains governed by its accepted terms unless a change is agreed or required by law. Material changes to ongoing subscription terms will be communicated where required.
